Welcome to Cozy Kringle! The terms “we”, “us” and “our” refer to Cozy Kringle. Cozy Kringle operates this online store and website, which sells soft and comfortable beds for dogs, cats, and other pets (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with the policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

Section 1 - Access and Account

By using the Services, you confirm that you are at least 18 years old (or the age of majority in your state of residence). To browse or purchase from our store, you may be asked to provide information such as your email address, billing details, and shipping address. You confirm that all information you provide is correct, current, and complete.

You are responsible for keeping your account credentials secure and for all activity under your account. You may not transfer, sell, or license your account to anyone else.

Section 2 - Our Products

We try to show our products as accurately as possible. However, colors, sizes, and appearance may look different on your screen depending on your device and settings. Our pet beds are handmade or manufactured items, so slight variations in size, shape, color, and stitching may occur.

We do not guarantee that a product will meet your expectations or match its photos exactly. Product descriptions, designs, and availability may change at any time without notice. We may discontinue any product or limit quantities at our discretion.

Section 3 - Pet Safety and Product Use

Our beds are designed for resting and sleeping only. For the safety of your pet, please follow these guidelines:

  • Our products are not chew toys. Do not allow your pet to chew, tear, or swallow any part of the bed or its fabric.
  • Some products have decorative parts such as antlers, pom-poms, embroidery, ornaments, or ropes. Check these regularly, and remove the product from your pet if any part becomes loose or damaged.
  • Supervise your pet, especially puppies, kittens, and pets who like to chew.
  • Choose the right size for your pet using the size information on the product page.
  • Follow the care instructions on the product page or label.
  • Do not use the product for any purpose other than as a pet bed.

You are responsible for deciding whether a product is suitable for your pet’s size, age, health, and behavior. If your pet damages or swallows part of a product, contact a veterinarian immediately.

Section 4 - Orders

When you place an order, you are making an offer to purchase. We may accept or decline any order for any reason. Your order is not accepted until we confirm it, and we must receive your payment first. Please review your order carefully before submitting, because we may be unable to cancel or change an order after it has been accepted. If we cancel or change your order, we will try to notify you using the email, phone number, or address you provided.

Returns and exchanges are governed by our Refund Policy. You confirm that your purchases are for your personal use and not for resale.

Section 5 - Prices and Billing

Prices, discounts, and promotions may change without notice. The price you pay is the price in effect when you place your order, shown in your order confirmation email. Unless stated otherwise, prices do not include taxes, shipping, or handling charges. Promotions may have their own terms, which will apply if they conflict with these Terms.

You confirm that (i) the payment information you provide is true and complete, (ii) you are authorized to use the payment method, and (iii) you will pay all charges at the posted prices, including shipping, handling, and applicable taxes.

Section 6 - Shipping and Delivery

Delivery times shown in our store are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, customs, holidays, or other events outside our control. Please see our Shipping Policy for more details. Once we hand your order to the carrier, ownership and risk of loss pass to you. Please provide a correct shipping address, as we are not responsible for orders sent to an incorrect address you provided.

Section 7 - Seasonal and Limited Products

Some of our products are seasonal or limited-edition (for example, Christmas-themed beds). These items may sell out, be discontinued, or not be restocked. During holiday periods, order processing and delivery may take longer than usual.

Section 8 - Intellectual Property

All content on our Services, including logos, brand names, text, images, product photos, graphics, and designs, is owned by Cozy Kringle or its licensors and is protected by U.S. and international intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, or republish any content without our written permission.

Section 9 - Optional Tools and Third-Party Links

We may provide access to third-party tools, and our Services may contain links to third-party websites. We do not control these tools or websites and are not responsible for their content, accuracy, or privacy practices. You use them at your own risk. Questions or complaints about third-party products or services should be directed to those third parties.

Section 10 - Relationship with Shopify

Cozy Kringle is powered by Shopify. Any purchase you make in our store is made directly with Cozy Kringle. Shopify is not responsible for any aspect of the sale, including any injury, damage, or loss resulting from products you purchase.

Section 11 - Privacy

Your personal information is handled according to our Privacy Policy. Because our store is hosted by Shopify, Shopify also processes some personal information, as described in our Privacy Policy and Shopify’s own privacy policy.

Section 12 - Customer Reviews and Feedback

If you submit reviews, photos, comments, or other content (“Feedback”), you grant us a worldwide, royalty-free, perpetual license to use, reproduce, edit, publish, and display it (including photos of your pet) for operating and promoting our business. You confirm that you own or have the right to share your Feedback and that it does not violate any law or third-party rights. We may remove any Feedback that is unlawful, offensive, misleading, or violates these Terms. We are not responsible for Feedback posted by users.

Section 13 - Errors and Inaccuracies

Our Services may occasionally contain typographical errors or inaccuracies in product descriptions, pricing, availability, or shipping information. We may correct any errors and change or cancel orders affected by an error at any time, including after you have placed your order. If we cancel your order because of an error, we will refund any payment you made.

Section 14 - Prohibited Uses

You may use the Services for lawful purposes only. You may not:

  • Use the Services for any unlawful, fraudulent, or harmful purpose.
  • Violate any law or regulation, or infringe the rights of others.
  • Harass, abuse, or threaten any person.

Sections that by their nature should continue after termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will remain in effect.

The Services and all products are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, and non-infringement, except where such warranties cannot be excluded by law. Section 17 - Limitation of Liability

To the fullest extent permitted by law, Cozy Kringle and its owners, employees, partners, suppliers, and service providers (and Shopify and its affiliates) will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for any lost profits, lost data, or similar losses, arising from your use of the Services or our products. This includes any injury or harm to a pet or person resulting from misuse of a product or failure to follow the guidelines in Section 3, to the extent permitted by law. Our total liability for any claim will not exceed the amount you paid for the product that is the subject of the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

Section 18 - Indemnification

You agree to defend and hold harmless Cozy Kringle, Shopify, and our affiliates, employees, and service providers from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from (1) your breach of these Terms, (2) your violation of any law or third-party rights, or (3) your use of the Services.

Section 19 - Severability

If any part of these Terms is found to be unlawful or unenforceable, that part will be enforced to the fullest extent permitted, and the rest of the Terms will remain valid.

Section 20 - Entire Agreement and Waiver

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, are the entire agreement between you and us and replace any earlier agreements. If we do not enforce a right or provision, this does not mean we have given it up.

Section 21 - Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer or assign these Terms without notice to you.

Section 22 - Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be handled exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

We may update these Terms from time to time by posting the new version on this page with a new “Last updated” date. Your continued use of the Services after changes are posted means you accept them.
